Police Inspection Notes

■Please confirm that the Supreme Court's case No. 1474 of 1970 and the Ministry of Justice's letter of interpretation No. 16531 of August 2, 1994 have both determined that "Hotel rooms: each has its own supervisory authority. If a specific person has registered as a guest in accordance with regulations, it is a place for travelers to live and it does not lose its residential nature..." According to the above case and interpretation letter, it can be determined that if a hotel room has been registered as a guest in accordance with regulations, it is not a public place and the police must not enter the room for inspection at will.
■If you have registered your identity information at the counter according to the regulations, if the police knock on the door for a check, they must first ask you to show your identity card and record it in detail (when they are in plain clothes) and then ask them to show the search warrant before they are allowed to enter. Otherwise, they can be refused entry for a check. If they still force their way in, they can be reported according to the law. Note: If the uniformed police refuse to state the name of their unit, you can record their armband number to verify their identity.
■Article 306 of the Criminal Law: Anyone who invades another person's residence, building, or the surrounding land or ship without cause shall be sentenced to fixed-term imprisonment of not more than one year, detention, or a fine of not more than NT$300. (The person must be sued before being prosecuted)
■Article 306 of the Criminal Code: Anyone who searches another person’s body, residence, building, boat, vehicle or aircraft without permission from the law shall be sentenced to fixed-term imprisonment of not more than two years, criminal detention or a fine of not more than NT$300.
■Article 157 of the Police Duty Code: "In general, the principle of hotel inspections is to check the hotel instead of the guests, and to check indirectly instead of directly, so as to avoid disturbing the guests. When checking hotel rooms, they should be carried out together with the staff. When entering each room, they must knock on the door first, and they must not lift the bed curtains and bedding at will. If it is necessary to check the luggage of the guests, they should open it and take it out for inspection. Unless they are considered to be seriously suspected of a crime, they should not search the body of the guests lightly."
